Terms of Service

MarketReady helps users create product marketing images and videos with AI. The service may include account tools, product image uploads, guided generation flows, preview features, credit purchases, downloads, support, and related features.

We may update, change, limit, suspend, or discontinue any part of the service at any time. We do not guarantee that any feature will always be available or error-free.

You are responsible for the information you provide, the activity under your account, and keeping your login credentials secure. You must notify us promptly if you believe your account has been compromised.

You may not share access in a way that misuses the service, bypasses limits, or violates these Terms.

You keep ownership of product photos, text, prompts, settings, and other materials you upload or submit to MarketReady ("User Content").

You represent that you have all rights and permissions needed to upload and use your User Content with MarketReady, including rights related to products, brands, logos, packaging, people, locations, and third-party materials shown in the content.

You grant MarketReady a limited, worldwide, non-exclusive license to host, store, reproduce, process, display, and modify your User Content only as needed to provide, maintain, secure, troubleshoot, and improve the service.

Subject to these Terms and your compliance with applicable law, you own the images, videos, and other outputs generated for you through MarketReady ("Outputs"). You may use your Outputs for commercial purposes.

MarketReady retains the limited rights needed to operate the service, including storing, displaying, processing, and reproducing Outputs for your account, support requests, safety, debugging, service improvement, and legal compliance.

AI-generated content can be similar or identical to content generated for other users. We do not guarantee that Outputs are unique, protectable by intellectual property law, accepted by any platform, or free from third-party claims.

MarketReady may generate content that is inaccurate, incomplete, distorted, unsuitable, offensive, or not appropriate for your intended use. You are responsible for reviewing Outputs before publishing, selling, advertising, or otherwise using them.

You are responsible for ensuring that your User Content, Outputs, product claims, advertising copy, testimonials, endorsements, pricing claims, and marketplace listings comply with applicable laws, platform rules, and industry requirements.

MarketReady does not promise any business result, increase in sales, advertising performance, platform approval, or customer response from using the service.

MarketReady may let you purchase credits that can be used for eligible generation, download, or other paid features. Prices, credit amounts, and included features may change over time.

Payments are processed through Stripe or another payment provider. By purchasing credits, you authorize the applicable charges and agree to the payment provider's terms.

Credit purchases are final and non-refundable except where required by law. Credits do not expire unless we clearly state otherwise for a specific promotion, product change, or legally required reason.

We may correct credit balances, cancel transactions, or restrict access if we detect fraud, abuse, payment failure, chargebacks, technical errors, or violations of these Terms.

You may not use MarketReady to create, upload, request, or distribute illegal content, infringing content, deceptive advertising, malware, spam, or content that violates another person's rights.

You may not attempt to bypass service limits, interfere with the service, scrape or reverse engineer the service, access accounts or data without authorization, or use MarketReady in a way that harms the service or other users.

You may not use MarketReady to misrepresent products, make false or unsupported claims, impersonate another person or business, or create content that you are not legally allowed to use.

We may suspend or terminate your access to MarketReady if we believe you violated these Terms, created risk for MarketReady or other users, failed to pay amounts owed, or used the service unlawfully or abusively.

You may stop using MarketReady at any time. Some provisions of these Terms will continue after your access ends, including ownership, payment, disclaimers, limitation of liability, indemnity, and dispute provisions.

MarketReady is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the service or any Output will be uninterrupted, secure, accurate, complete, or suitable for your needs.

To the fullest extent permitted by law, MarketReady will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or loss of goodwill.

To the fullest extent permitted by law, MarketReady's total liability for any claim relating to the service or these Terms will not exceed the amount you paid to MarketReady in the three months before the event giving rise to the claim, or $100 if you paid nothing.

You agree to defend, indemnify, and hold harmless MarketReady from claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys' fees, arising from your User Content, Outputs, use of the service, violation of these Terms, violation of law, or violation of another person's rights.

These Terms are governed by the laws of the State of New York, without regard to conflict of law rules.

Any dispute arising from or relating to these Terms or MarketReady will be brought only in the state or federal courts located in New York, New York, and each party consents to the personal jurisdiction and venue of those courts.

We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify users, such as posting the updated Terms on the website or providing notice through the service.

Your continued use of MarketReady after updated Terms become effective means you accept the updated Terms.
